1. Definitions & Scope

• "The Signature Standard" refers to the aesthetic enhancements, virtual staging, and digital marketing assets provided by Signature Design House (SDH).

• "Output" refers to the final enhanced/staged images and marketing materials delivered to the Client.

 

2. Client Representations (Photo Ownership) By uploading any image to our studio (via FileRequestPro or otherwise), you warrant that:

• You are the legal owner of the image or have obtained explicit written permission from the original photographer/copyright holder to alter the image.

• You indemnify Signature Design House against any claims of copyright infringement brought by third-party photographers.

 

3. Intellectual Property & Usage Rights

• Client Ownership: Upon full payment, the Client is granted a perpetual, non-exclusive license to use the Output for the marketing of the specific property listing.

• Agency Portfolio License: Signature Design House retains a perpetual, worldwide, royalty-free license to use both the "Before" and "After" images for portfolio, social media, advertising, and educational purposes. We will never disclose sensitive owner data (names/exact unit numbers) in these materials.

 

4. Service Delivery & Refinements

• Turnaround: We aim for a 48-hour delivery. Delays due to technical issues or "High Volume" status (indicated by our Studio Status dot) do not constitute a breach of contract.

• Refinements: Each project includes one round of "Signature Refinements." Major changes to style or room layout requested after the initial brief may incur additional fees.

 

5. Regulatory & MLS Compliance (Mandatory Disclosure)

• Truth in Advertising: Per NAR Article 12 and Texas real estate guidelines, all virtually staged photos must be disclosed. SDH may apply a subtle "Virtually Staged" watermark to ensure your listing remains compliant.

• Liability: SDH is not liable for MLS fines, listing removals, or buyer claims resulting from a Client’s failure to disclose virtual alterations.

 

6. Limitation of Liability

• Our staging is for visualization purposes only. It is not to scale and should not be used for construction or structural planning.

• SDH is not liable for "lost profits" or "days on market" fluctuations. Our services are an aesthetic intervention, not a guaranteed financial outcome.
